1. Introduction and Acceptance

Welcome to HSK Tracker ("we," "our," or "us") by Olys Consulting. By accessing our website at www.hsktracker.com, downloading our mobile applications (iOS and Android), or using our services, you agree to and are bound by these terms. If you disagree with any part of these terms, you may not access our service.

These Terms of Service ("Terms") govern:

  • Your rights and responsibilities as a user
  • Our rights and responsibilities as a service provider

2. Service Description

2.1 Core Services

HSK Tracker is your ultimate tool to boost your HSK exam scores. Our platform provides comprehensive features including the Tracker Board for progress monitoring, complete HSK vocabulary lists from levels 1 to 6, customized Writing Lists, and printable resources. We support both current and new HSK versions.

2.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our service with 30 days notice. For significant changes, we will provide notification via email and/or platform notifications.

3. Account Terms & User Responsibilities

3.1 Account Creation and Maintenance

To access our services, you must:

  • Complete the registration process
  • Provide accurate, complete, and updated information
  • Maintain the security of your account credentials

3.2 Prohibited Activities

Users are expressly prohibited from:

  • Unauthorized access or use of our systems
  • Sharing or distributing HSK Tracker's proprietary content without permission
  • Creating multiple accounts for abusive purposes
  • Using automated systems, "robots," "spiders," or bots to access the service
  • Attempting to reverse engineer, decompile, or disassemble the platform
  • Sharing account credentials with others
  • Collecting or harvesting any personally identifiable information from the service
  • Interfering with or disrupting the integrity or performance of HSK Tracker
  • Using HSK Tracker to build a competitive product or service
  • Using any data mining, scraping, or similar data gathering methods to collect content or vocabulary data
  • Attempting to circumvent any content-filtering techniques or security measures

Violation of these prohibitions may result in immediate termination of your account and legal action.

4. Billing and Payments

4.1 Pricing and Payment Terms

Our pricing structure and payment terms are as follows:

  • We offer 2 package options: Monthly or annual subscription
  • Billing occurs monthly or annually, depending on your chosen plan
  • Web payments are processed through secure payment providers (Stripe)
  • Mobile app payments are charged to your Apple App Store or Google Play account at confirmation of purchase
  • Applicable taxes will be calculated and added to your bill

4.2 Subscription Terms

Subscription details and management:

  • Minimum subscription period: 1 month
  • Automatic renewal unless cancelled 24 hours before renewal
  • Plan upgrades take effect immediately
  • Plan downgrades apply at next billing cycle
  • Web subscriptions can be cancelled through your account settings
  • Mobile app subscriptions can be managed and cancelled through your App Store or Google Play account settings
  • Free trials (if offered) automatically convert to paid subscriptions unless canceled before the trial ends

4.3 Refunds and Credits

Refunds are handled on a case-by-case basis. For web subscriptions, if you believe you are entitled to a refund, please contact our support team. We do not provide prorated refunds for partial use of a service period.

For mobile app purchases, all refunds are subject to the refund policies of the Apple App Store or Google Play Store. Please contact Apple or Google directly for refund requests.

5. Data Protection and Privacy

6. Intellectual Property Rights

6.1 Our Intellectual Property

All content on HSK Tracker, including but not limited to the vocabulary lists, character writing guides, tracking systems, and educational materials, are protected by copyright and other intellectual property rights. These materials are the exclusive property of HSK Tracker and its licensors.

6.2 License Grant

We grant you a limited, non-exclusive, non-transferable license to use HSK Tracker for personal, educational purposes. This license is strictly for your personal use and cannot be shared or transferred to others.

The HSK vocabulary is based on official Chinese language proficiency standards, but the specific presentation, organization, study algorithms, and user interface are our proprietary intellectual property.

7. Content Accuracy

While we strive to provide accurate HSK vocabulary and learning materials, we do not warrant the completeness or accuracy of the information provided. Users should verify critical information independently.

HSK Tracker is not affiliated with Hanban, the Chinese Testing International Co., Ltd., or official HSK testing authorities. Users should verify critical testing information through official channels.

Using HSK Tracker does not guarantee success on HSK examinations.

8. Termination

8.1 Termination Rights

Account termination can occur:

  • At your request through your account settings
  • For violation of these Terms of Service
  • For extended periods of account inactivity
  • If required by law or regulatory requirements

8.2 Effect of Termination

Upon termination:

  • Access to services will cease immediately
  • Your data will be retained for 30 days
  • You can request a copy of your data during this period
  • Any outstanding payments will be processed
  • For mobile app users: you may discontinue use by deleting the app

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • HSK Tracker is provided "as is" without any warranties
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid for the service in the past 12 months
  • We do not guarantee specific HSK exam results or outcomes
  • We are not responsible for any technical issues beyond our reasonable control

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of France without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

11. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12. Age and Parental Consent

HSK Tracker is suitable for users of all ages. For users under 13 years of age, a parent or guardian must review and agree to these Terms on their behalf.

Parents and guardians are responsible for supervising their child's use of HSK Tracker and for any activities conducted under their child's account.

If we learn that we have collected personal information from a child under 13 without parental consent, we will delete that information promptly. Please contact us at support@hsktracker.com if you believe this has occurred.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Your continued use of HSK Tracker after changes constitutes acceptance of the modified terms.

We will make reasonable efforts to notify users of material changes through the website, mobile app, or email.
